Local man faces assault charges

NEWKIRK — Wayne Keith Cotton, 56, Ponca City, was arrested on Friday and charged with assault and battery with a deadly weapon and a felon in possession of a firearm. His bond was set at $200,000.

According to the probable cause affidavit, officer John Garcia was dispatched to the 900 block of South Fifth Street in Ponca City on March 25 at 4:40 p.m. for a subject that reported Cotton shot at his vehicle.

An officer said after arrival, he made contact with two subjects that performed repairs on a vehicle and took it for a test drive. They allege they went to Cotton’s salvage yard to get some seats that he was going to sell them and had a prior verbal agreement to purchase the seats for $100. The two allege that when they went to get the seats they got into a dispute over the cost. The two allege that when they were in the vehicle they heard three or four gunshots.

The officer said he observed two bullet holes in the driver’s side of the pickup, one to the rear of the bed and another just behind the driver’s door. The bullet that hit the front of the vehicle entered the cab of the truck, striking a plastic storage compartment built into the side of the interior.

The officer advised he made contact with Cotton and told him what the pair said. He said they had a disagreement over the cost and that the two started making threats and calling him racial slurs.

Cotton claims he feared for his life so he retrieved a gun and fired shots in the air in the direction of the vehicle.

The officer had dispatch run a criminal history on Cotton and his history indicated he was a convicted felon. He was arrested at that time and transported to the Kay County Detention Center. Initial appearance is scheduled for April 3 at 9 a.m.
