Judge Denies Revoke Bond Motion From D.A. on Cannon

NEWKIRK — Kay County District Judge D.W. Boyd on Monday denied a motion to revoke bond for William Clifton Cannon.

The motion, filed April 25 by the Kay County District Attorney's office, would have revoked bond in six cases pending against Cannon, 37, of Ponca City.

District Attorney Mark Gibson said Tuesday that Cannon's bond was increased by $100,000 and that Cannon was allowed to remain free and given 48 hours to raise the money.

"The District Attorney's office is extremely concerned that Mr. Cannon is a danger to everyone in the Kay County area," Gibson said.

"He has repeatedly, blatantly violated the terms of his bond. In spite of that, the District Court, over our objection, decided to allow him to remain free on house arrest. The court increased bond and allowed him to remain free for 48 hours to make bond. In my 22 years of experience this is unprecedented. We strongly disagree with the judge's decision, but it is his decision to make," Gibson said.

Among the charges, Cannon is facing a misdemeanor count of assault and battery and violation of a protective order.

He was arrested by Ponca City police April 18, following an incident at the Ponca City Wal-Mart in the 1100 block of East Prospect.

According to an affidavit prepared by officer Brad Kills Crow, Cannon is accused of assaulting members of the James Parker family in the store, including a 3-year-old boy.

Several members of the family filed protective orders against Cannon in March 2007 in connection with death threats they said Cannon made to them.

Cannon left the country sometime after the incident in Wal-Mart.

Cannon's attorney, Ken Holmes, said Thursday that the district attorney's office was notified in writing that Cannon wanted to leave the country on a business trip, but Cannon made the trip without his knowledge.

Holmes said Cannon returned from the trip to Ponca City between 10 and 10:30 a.m. Thursday and reported voluntarily to court. During that court appearance, Cannon was placed under total house arrest.

Cannon also faces two felony charges of assault with a dangerous weapon and a misdemeanor charge of assaulting a police officer in a Jan. 29, 2007, incident.

According to affidavits prepared by Ponca City police officers and Kay County Sheriff's deputies, Cannon is accused of making threatening phone calls to the Ponca City Police Department on the evening of Jan. 29, 2007, and firing shots at officers and deputies.

On March 8, 2007, Cannon was arrested during a traffic stop in the 3200 block of North Fourteenth Street and later charged with four misdemeanor charges of placing obscene and threatening phone calls and a misdemeanor count of stalking.

According to the affidavits in those cases, Cannon is accused of making death threats to an electrician and members of the Parker family, resulting in five protective orders being issued against him.

Cannon appeared in Kay County District Court on those charges March 9, 2007.

At that time, bond was denied by Judge Lee Stout and Cannon was ordered detained in the Kay County Jail until proof was provided to the court of admittance into a psychiatric hospital.

Other conditions also were placed on his release, including wearing an ankle bracelet monitoring his location. He also was ordered to have no contact with any victims in the cases.

The ankle bracelet was removed on Feb. 7, 2008, and bond was reduced according to an order signed by Judge Stout.

A felony charge of use of a vehicle in the discharge of a weapon was added to the list of charges on Sept. 4, 2007.

In that case Cannon is accused of shooting at the Parker residence in the 1600 block of Queens.

Bullets recovered from the scene were sent to the Oklahoma State Bureau of Investigation for comparison with bullets taken from the Cannon residence.

According to an affidavit prepared by Ponca City Police Lt. Bob Stieber, a report by OSBI criminologist Gordon Robertson indicated that the bullets were a match.

Cannon was released on a $25,000 bond by Judge Stout on the same conditions the same day he was charged.

During Monday's hearing, Cannon's bond was increased to $150,000 and the ankle bracelet put back in place with weekly reports to be submitted to the district attorney's office.

He was placed under house arrest with the following exceptions: Medical appointments, church attendance and appointments with his attorney. A member of his attorney's staff or his grandfather or mother must provide documentation for him to leave the residence.

Cannon was ordered to surrender his passport.

A preliminary hearing is set for 9 a.m. June 20.
