A federal grand jury in the U.S. District Court for the Western District of Oklahoma has indicted two U.S. Postal Service Postmasters from Kay County, acting U.S. Attorney Robert J. Troester confirmed Wednesday.
Divina M. Love, 41, Postmaster at the U.S. Post Office in Tonkawa, was indicted on a felony charge of misappropriation of postal funds.
The indictment states Love converted to her own use more than $1,000 in postal funds due to the U.S. Postal Service for stamp sales from funds coming into her custody and control as a result of her employment and service as Postmaster. It also states she did not properly and lawfully account for the funds.
Ponca City Postmaster Steven R. McCormack, 55, was indicted on a felony charge of misprision of a felony.
The indictment states McCormack had knowledge of the actual commission of a felony when Love embezzled postal funds.
It further states he used his personal funds to purchase postage stamps which he provided to Love to conceal the embezzlement and did not reveal her crime to authorities.
Both Love and McCormack are free on unsecured bonds of $5,000, according to the criminal cover sheets which accompanied the indictments.
According to the criminal cover sheets, the penalty for Love's charge, if she is convicted, is not more than 10 years imprisonment, a fine equal to the amount or value of the money or property or both; three years supervised release and a $100 special assessment.
The penalty for McCormack's charge, if he is convicted, is not more than three years imprisonment, $250,000 fine or both; one year supervised release and a $100 special assessment.
Dionne Montague of the Houston office of the U.S. Postal Service said Wednesday the title of the postmasters would not change until there is some resolution to an investigation.
Special Agent Kenny Smith with the U.S. Postal Services' Office of Inspectors General confirmed Wednesday that the cases against Love and McCormack are being worked by Oklahoma City agents of the Office of the Inspector General of the Postal Service and the investigations are ongoing.
