The Kay County District Attorney's office filed a second-degree murder charge against 26-year-old Noah M. Daniels of Ponca City on Friday in the June shooting death of Jesse Carlile, 21, also of Ponca City.
The information filed in the case by Assistant District Attorney Jennifer Layton states Daniels shot Carlile with a 9 mm semi-automatic handgun while engaged in the crime of possession of a firearm after a former conviction of a felony.
A list of 40 witnesses has been endorsed for the State of Oklahoma in the case.
Supplemental information filed in the case states Daniels was convicted in 2002 in Cook County, Ill., Circuit Court of a felony charge of possession of a stolen vehicle, and in 2001 was convicted in the same court of a felony charge of burglary in the second degree.
In August 2003, Daniels was convicted in the District Court of Tulsa County of a felony charge of assault and battery with a dangerous weapon and sentenced to five years in the Department of Corrections.
Carlile was shot June 6 at Attucks Park and died June 7 in a Wichita Hospital. He was a passenger in a car which fled the park northbound on Twelfth Street after the shooting. The car crashed and caught fire at Twelfth Street and Oklahoma Avenue minutes after the shooting.
Daniels was convicted in Kay County District Court on June 18 of two counts of possession of a controlled dangerous substance and trafficking in illegal drugs.
He was sentenced to five years in prison and 15 years probation on each of the charges and has been incarcerated in the R.B. Dick Conner Correctional Center in Hominy since July 28.
Layton said Friday the District Attorney's office will file a writ to bring Daniels back to Kay County from the Department of Corrections to address the murder charge. Published Sun, Nov 15, 2009, On Page 1 A Copyright ©1998-2010 The Ponca City News |
