Ponca City Man Facing Charges Over Homicide

A 35-year-old Ponca City man, arrested in connection with a homicide, remains at the Ponca City jail.

According to the Ponca City Police Department, the suspect was taken into custody Friday as an accessory after the fact of the murder, which occurred on Jan 14. He is believed to have helped hide murder suspect, Juan Carlos Alvarado Duarte. Detectives also believe he may have assisted Duarte in leaving town.

Sgt. Bob Stieber said the accessory suspect concealed information from detectives. A probable cause hearing was held Sunday. The Detective Division expects the subject to be taken to the Kay County Sheriff's Office on Tuesday, to be formally arraigned.

The PCPD believe the murder occurred at a residence in the 900 block of East South Avenue. A material witness remains in custody as well as evidence from the crime scene.

On Jan. 20, a warrant for, the arrest of the 24-year-old Hispanic murder suspect, was issued. The National Crime Information Center has information about the suspect as well as another material witness, Abbie Blueback. The 28-year-old Indian woman is believed to be traveling with Duarte.

According to the department, the murder suspect's vehicle was found in Dallas on Jan. 19.

Martin Zamora Briones, aka Gallo, aka Briones Martinez, a 30-year-old Hispanic male, has been identified by the PCPD as the homicide victim. However, the body has not yet been found.

Natural Gas Costs Idle Power Plant

The Ponca City power plant, 1400 North Union Street, remains idle during the winter months due to the high cost of natural gas.

According to Phil Johnston, system engineer, economics determine where power will be obtained. The need for power is less during the winter months which allows some plants to remain on a stand-by status, he said.

"We do not need to use all the power all the time," he said. "This time of year coal-fired plants are cheaper to run," he said. "We are trying keep the costs low so the citizens don't have to pay more than necessary."

Since the city buys power from the Oklahoma Municipal Power Authority, there is opportunity to obtain power from multiple plants.

Furthermore, the electric load usually begins picking up around May. Depending on economics, the city's natural gas-powered plant should be back to work this spring.

The system engineer confirmed coal-fired plants provided lower rates last month and he anticipates lower rates this month, too.

Two Intersections Closed All Week

Two intersections will be closed all week as work on the Northwest Water Transmission Pipeline project continues.

According to Steve Shea, Ponca City Engineering Department, the intersection at South Eleventh Street and East Central Avenue and the intersection at South Thirteenth Street and Central Avenue will be closed Monday through Friday for street repairs.

Additionally, the alley located between Third Street and Fourth Street and Grand Avenue and Central Avenue will be closed for repairs Tuesday through Friday, according to Corky Gammon, with the Street Department.

Lawful Search Can Be Made Without Warrant

Ponca City police officers are not required to have a warrant before pursuing a lawful search.

Under the fourth amendment, people have the right to be secure in their persons, houses, papers and effects, against unreasonable searches and seizures. However, a search can be conducted if there is probable cause, supported by oath or affirmation, and the officer describes the place to be searched and the persons or items to be seized.

According to Capt. Clayton Johnson, several exceptions to the search warrant requirement include:

- A person giving a police officer permission to conduct a search. Permission can be verbal or in writing.

- In the event of a lawful arrest, the person and area of immediate control of the person arrested can also be searched. In a motor vehicle, the entire passenger compartment can be explored.

-Vehicles can be searched upon probable cause due to the mobility of the vehicle. When a vehicle is impounded, the officer takes an inventory of the property in lawful custody.

- A search is legal, if there is reasonable suspicion that an officer's life may be in danger or that a suspect is likely to escape or destroy evidence.

Johnson also said searches of abandoned property, open fields, public access areas and garbage at the curbside can be complete without a warrant.

Search warrants are issued in district court, and are difficult to obtain, said Johnson.

"Very seldom do we not find what we're looking for after a search warrant is acquired," the captain said. "Also, if looking for one item, but an officer finds something else, the officer must take it into custody. Contraband cannot be left," he said.

Ponca City Ninth Grade Boys Win Championship

Ponca City's ninth grade boys broke up a tight battle against Stillwater with a 21-8 explosion in the fourth quarter Saturday night to win the Northern Junior High Conference Tournament title in Robson Fieldhouse, 56-41.

The ninth grade girls lost a hard fought 24-19 decision to Stillwater in the girls' finals.

The Cougars have some unfinished business on Tuesday as they host Enid Emerson for a make-up game in the mid-hi gym at 6 p.m., following the eighth grade game. The Lady Cougars will play at Emerson.

The ninth graders, 13-2 overall and 7-0 in conference play, will be seeking to complete a perfect conference schedule.

Ponca City broke to a 17-6 lead in the first quarter, but cooled off in the second as Stillwater came back to close the gap to 25-23.

It was still a two-point game, 35-33, at the end of the third period. But the Poncans caught fire midway through the final stanza to pull away despite hitting just 18-of-36 free throw attempts.

"If we hit our free throws it wouldn't have been a game," Ponca City coach Keith Chronister said. "But the kids player hard and really went after them on defense. Brett Skaggs really stepped up. He had an incredible game. He was credited with 10 steals. He had at least that many. On our press he just stripped the ball away time and time again."

The Cougars also got good balance in scoring. Barry Chance had 14 points, Skaggs 12, Jeff Furnas 11, Blake Geubelle 10 and Evan Rupp 9.

"These kids have worked hard and they are really fun to watch," Chronister said. "Some of these guys played football, too, so this is their second conference championship. They are just a great bunch."

In the girls' finals, Stillwater pulled away in the fourth quarter after the Ponca Citians had stayed close through three periods, trailing just 15-13.

"We just had too many turnovers," coach Lela McCracken said. "But Stillwater played a good game. The lid was on the basket, but the defense looked good."

Alana Smith and Brooke Hines each had 5 points, Nikki Stuemky 4, Mea Alexander 3 and Kristl Richardson 2.

Alexander, Laura Sudbury and Smith were named to the All-Conference team.

Ponca City's girls set up the expected battle with Stillwater with a 40-29 win over Enid Emerson in Robson Fieldhouse Friday.

Stuemky led the way in that game with 11 points while Sudbury had 7, Hines 6, Allison Stotts 5, Smith 4, Alexander 2, Richardson 2, Kami Schieber 2 and Taylor Thomas 1.

Crowder then outscored the Lady Mavs 34-28 in the second half to record the nine-point win.

Lynetta Geter topped Northern with 19 points and added 8 rebounds. Sherry Butts had 14 points, Jennifer Whittet 10, Mandy Perkins 8, Cathy Rogers 4, Michelle Brown 3, T.J. Humphreys 2 and Jill Kliewer 2. Brown led Northern in rebounds with 10 and Brandi McClellan had a team-high 7 assists.

"We didn't play that badly," said head coach Greg Krause. "They just really shot the ball well. I don't have their shooting statistics but I know that they shot really well.

"We needed to be in their face more, defensively. We game them just a little too much time to shoot."

Northern, which defeated Crowder 79-55 in Tonkawa, slipped to 17-9 overall but is 6-0 in the Bi-State West. The Lady Mavs resume Bi-State West play tonight in Tonkawa against St. Gregory's. The game is scheduled to tip off at 6 p.m. with the men's game to follow.
